Can the mother order the biological father not to see their child without a court order?
My brother-in-law has a 9 month old boy with his ex-girlfriend. They never got married, but been together until a month ago. He has since moved to his mother's house while he looked for a job. The baby and mother lives with her family. He and his family has supplied most of the baby's big necessities (like the crib, car seat, clothes, etc), while WIC provided the child's food. They came to a verbal agreement that he can see the baby every other weekend and Wednesdays. Now she doesn't want him to see the baby since he is not sending her money because he not working. They have not gone to court yet to settle any child support, but whenever the child needs anything while he is in his care, he supplies it. He has been effortlessly looking for a job but has not been called for one in these times of unemployment. However, when the baby is with him, the baby has always been taken care of very well since he has the support of his mother and brother. All he cares is that he can be involved with his child (unlike some fathers), and that he is taken care of. Is it possible that he can get joint custody in Florida if he doesn't have a job right now, and doesn't have a place of his own (even though he has his own room at his mother's house)? Can she tell him not to see the kid without a court order or a plausible reason?
